General terms

This document, containing the terms and conditions of use of the etiquettemed.ro website, sets out the conditions under which anyone may visit or access the etiquettemed.ro website, or use in any way the services offered through the website.

“Site” automatically means the etiquettemed.ro website; “Site Administrator” means Giadent Smile Dental Clinic, with its registered office at Gladiolelor, no. 1, Sibiu, Romania; “Service” is synonymous with any service offered by the giadentsmile.ro website and any component thereof; “User” further means any person who visits or accesses the website and who wishes to use the Service in any way.

Failure to accept the Terms and Conditions or any provision thereof, as worded in this document, obliges the User to stop accessing the website immediately; continued access to or visiting of the giadentsmile.ro website, any page of the website and use of the Service, as well as of any component thereof, constitutes full and unconditional acceptance of the Terms and Conditions set out here.

Rights over the content of the website

The content and graphic elements of the etiquettemed.ro website, including all text content and any other material, transmitted in any form to Users (by direct viewing on the website or through any other materials related to the website), belong entirely to the Giadent Smile dental clinic. By way of derogation from the preceding provision, materials for which another rights holder or another source has been indicated do not belong to the Giadent Smile dental clinic.

Where the content of the giadentsmile.ro website, regardless of where it appears on the website and regardless of type, is taken by Giadent Smile from other content producers or materials in text, image, graphic or video format, but without being limited to these, such use is made only in compliance with the legal provisions and the rules applicable in such cases.

Users understand and accept that all information and materials posted on the Giadent Smile clinic website are strictly informative and indicative in nature, and the Giadent Smile dental clinic is not liable in any case or in any way for the validity and truthfulness of the content of the etiquettemed.ro website or for any legal effect arising from its use.

The response received by the user after completing the contact form has in no way the value of a real consultation, and Giadent Smile Dental Clinic is not liable for the purely informative response sent, which does not constitute adequate medical treatment.

Users are obliged to respect all copyright and any other intellectual property rights that Giadent Smile holds over and in connection with the giadentsmile.ro website, its content or the use thereof. Users understand and accept that if any of the above provisions is breached to any extent, they may be held liable to the owners and authors of the content of the giadentsmile.ro website.

The content of the website, regardless of where it appears on the website and regardless of its type, may be used only for personal purposes, defined under this document as purely non-commercial purposes, without any direct or indirect intention of obtaining gains or profits of any kind from such use. Any use of content by third parties for purposes other than strictly personal may be made only with the prior, express written consent of the administrators of Giadent Smile Dental Clinic.

The sale, copying, reproduction, publication, reuse, transmission, or partial or total distribution, whether modified or in full, of the content of the giadentsmile.ro website or of any part thereof is completely prohibited. Giadent Smile Dental Clinic has the legal right to take legal action against any person or entity that breaches the above provisions in any way.

Personal data protection notice

In accordance with Law no. 677 of 2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, and the General Data Protection Regulation (GDPR) 2016/679, Giadent Smile Dental Clinic will manage, in conditions of complete security and strictly for the purposes specified below, the personal and non-personal data provided by Users. Users understand and accept that all personal and non-personal data they provide to Giadent Smile is processed for the purpose of Giadent Smile providing, in optimal conditions, internet services, statistics and the supply of goods and services.

The non-personal information we obtain about the user is: country of origin, device type (mobile or desktop), operating system, browser, screen resolution, time and pages visited on the website and the visitor’s source (organic (Google, Bing etc.) or direct).

The personal information we obtain is that which the user provides through the contact form on the website, and which we do not collect in any database but use strictly to answer the questions or suggestions put forward by the user. Such personal information is not and will never be shared or sold to third parties (Google, Facebook etc.) and will never be used for marketing purposes or unwanted advertising (spam) directed at the user.

The storage of non-personal information or the obtaining of access to information stored in the user’s equipment is carried out by Giadent Smile only for the following purposes: providing internet services and supplying goods and services. The third parties that have access to or store non-personal information from the equipment of the user of the giadentsmile.ro website are: providers of audience and website performance analysis services (Google Analytics). The general purpose of the information processing is the provision of internet services.

Under Law no. 677 of 2001, every User has the right of access, the right of intervention on the data, the right not to be subject to an individual decision and the right to apply to the courts.

At the same time, the User has the right to object to the processing of personal data concerning them and to request the erasure of such data.

Users understand and accept that this website may contain references or links to other internet sites, including social sites, which Giadent Smile considers useful in connection with the content of this website, but which are not under its full control.

Giadent Smile is released from any liability regarding the opinions or content expressed on all the sites mentioned above, as well as their accuracy and correctness, and Users understand and accept that these internet sites are not fully monitored, controlled or verified in any way by Giadent Smile.

The inclusion of a link to other internet sites does not imply any endorsement of them by Giadent Smile. When accessing these internet sites, users do so at their own risk, knowing that the use of the services they offer is subject to the conditions set by the administrators of those sites.

Limitation of liability

Giadent Smile does not guarantee and does not undertake any obligation, implicit or express, for the content of the website. Giadent Smile will make all reasonable efforts to ensure the accuracy of the Site and will try to correct errors and omissions as soon as possible.

Giadent Smile gives no warranties and cannot be held liable for any loss or damage that may result from the use of any part of the content of the website or from the impossibility of using it, regardless of the cause, or from the erroneous interpretation of the provisions of the website content.

Users understand and accept that the operation of the website may be affected by certain objective conditions, and that any service offered through the website is provided on an “as is” and “as available” basis, and Users use these services at their own risk. Consequently, the Site Administrator cannot be held liable for any information and data in the content of the website, including text, images, video sequences or any other activity related to use, nor for any other legal effect deriving from them.

Users understand and accept that the Administrator of this internet site is released from any liability in the event of any hindrance, stoppage, interruption, malfunction or error in the normal operation of the website, in the event of a technical error of any kind or any errors in the provision of the Service, and in any situation in which it is not clearly proven that any error or problem of a technical nature mentioned above is due exclusively and directly to the gross fault of the Administrator of this Site.

In cases of force majeure, Giadent Smile and its operators, directors and employees are fully exonerated from liability. Cases of force majeure include malfunctions of the Site Administrator’s technical equipment, failure of the telephone or internet connection, cyber attacks of any kind, computer viruses and interference with malicious software, operating errors, unauthorised access to the website’s systems, strikes, etc.

Users agree to protect and fully indemnify Giadent Smile Dental Clinic and its representatives against any actions, impositions, demands, claims, damages, costs (including the fees of lawyers, bailiffs and consultants or experts, court, enforcement or notarial fees), expenses, losses, judgments, fines, decisions, settlements or any other obligations arising from or related to any other action of the User connected with the use of the Service.

Applicable law. Disputes

The rights and obligations of Giadent Smile and of Users set out in the Terms and Conditions expressed here, as well as all legal effects produced by the Terms and Conditions, shall be governed and construed in accordance with Romanian law in force. Any dispute arising in connection with or directly from the Terms and Conditions presented here shall be settled amicably.

Changes to the Terms and Conditions

Giadent Smile dental clinic has the right at any time and in any way to modify any of the provisions expressed in the Terms and Conditions or the Terms and Conditions in their entirety, without any prior notice and without being obliged to fulfil any other formality towards Users. Any modification shall be considered fully, entirely and unconditionally accepted by every User through the use or access of any facility offered by this Site or by the Service, or through access to the website, occurring at any time after such modification(s) have been made, and non-acceptance of any of the modifications automatically obliges the User to stop accessing the website immediately and using the Service in any way.
